What the law requires

Italian Legislative Decree 81/2008 (Workplace Safety Act) requires employers to know at all times who is inside the facility, to ensure safety in an emergency.

Article 18(1)(i) mandates the adoption of emergency management measures. Article 43 requires an emergency plan that includes a headcount of people on site.

Failure to maintain an attendance register may result in administrative fines and, in the event of an incident, criminal liability for the employer.
